The Grand Jury of Breathitt County, in the the name and by the authority of the Commonwealth of Kentucky, accuse Elhanan Deaton and Bettie Sizemore of the offense of Lewdness and illicit cohabitation committed as follows, to-wit: that said Elhana Deaton and Bettie Sizemore on the 7th day of May 1909 in the County and Circuit afresaid did unlawfully, willingfully, openly and notoriously cohabit and have sexual intercourse together in the presence of J. C. B. Stidham, Ed Deaton and others they being at the time of the opposite sex and not married to each other against the peace and dignity of the Commonwealth of Kentucky.
